Consumer Commission cancels wrong electricity bill, orders Mahavitaran to pay ₹7,000 compensation
जालना: जिला उपभोक्ता तक्रार निवारण आयोग ने महावितरण द्वारा गलत तरीके से जारी किए गए ₹1,18,300 के बिजली बिल को रद्द करने का आदेश दिया है। साथ ही, उपभोक्ता किशोर गोपीकिशन बगडिया को ₹7,000 का मुआवजा देने का निर्देश दिया गया है। एडवोकेट महेश सीताराम धन्नावत ने कहा कि यह फैसला अन्य उपभोक्ताओं को गलत बिलिंग (Wrong Billing) से बचाने में मदद करेगा।
मामला क्या था?
महावितरण ने 2018 में उपभोक्ता का बिजली कनेक्शन स्थायी रूप से काट दिया था, जिसके बाद उन्होंने नया बिजली कनेक्शन लिया। लेकिन 2024 में, महावितरण ने अचानक ₹1,18,300 का पुराना बकाया भरने की मांग की। इतना ही नहीं, उन्होंने धमकी दी कि अगर उपभोक्ता ने यह राशि नहीं भरी, तो उनका चालू बिजली कनेक्शन (Active Electricity Connection) भी काट दिया जाएगा।
इस अन्यायपूर्ण मांग (Unfair Demand) के खिलाफ श्री बगडिया ने एडवोकेट महेश धन्नावत के माध्यम से जिला उपभोक्ता आयोग (Consumer Forum) में शिकायत दर्ज कराई।
उपभोक्ता आयोग ने महावितरण की मांग को अवैध ठहराया
एडवोकेट महेश धन्नावत ने आयोग के समक्ष ठोस प्रमाण प्रस्तुत किए कि 2018 में ही बगडिया ने महावितरण को बकाया राशि का भुगतान कर दिया था। हालांकि, कुछ चेक बाउंस होने के कारण, सितंबर 2018 में उन्होंने पुनः ₹89,850 का भुगतान किया था। इसके बावजूद, महावितरण द्वारा फिर से पुराना बकाया मांगना पूरी तरह गलत (Illegal Electricity Bill Recovery) था।
क्या कहता है विद्युत अधिनियम?
विद्युत अधिनियम 2003 (Electricity Act 2003) की धारा 56(2) के तहत, यदि किसी बकाया राशि को लगातार लंबित बकाया (Continuous Dues) के रूप में नहीं दर्शाया गया, तो दो साल से पुराने बिल की वसूली नहीं की जा सकती (Electricity Bill Recovery Rule)। इसी आधार पर, 2018 के बिजली बिल की वसूली महावितरण नहीं कर सकता, यह तर्क एडवोकेट धन्नावत ने उपभोक्ता आयोग के समक्ष प्रस्तुत किया।
आयोग का निर्णय:
- ✔ ₹1,18,300 के पुराने बकाया बिल को किया गया रद्द
- ✔ पुराने बिल को उपभोक्ता के नए कनेक्शन में स्थानांतरित करने पर रोक
- ✔ मानसिक और शारीरिक परेशानी के लिए ₹3,000 का मुआवजा
- ✔ शिकायत खर्च के लिए ₹4,000 का भुगतान—कुल ₹7,000 का मुआवजा
इस महत्वपूर्ण फैसले (Consumer Rights Protection) से गलत बिल वसूली (Wrong Electricity Bill) की घटनाओं पर रोक लगेगी और उपभोक्ता अधिकारों (Consumer Rights) की रक्षा होगी, ऐसा विश्वास एडवोकेट महेश धन्नावत ने व्यक्त किया।
