विवादित ढांचे पर सुप्रीम कोर्ट की टिप्पणी: मुस्लिम पक्ष की दलील गलत, हाई कोर्ट को संशोधन की अनुमति देनी चाहिए थी
नई दिल्ली — मुख्य न्यायाधीश संजीव खन्ना और न्यायमूर्ति पीवी संजय कुमार की पीठ ने सोमवार को विवादित ढांचे से जुड़े एक महत्वपूर्ण मामले में सुनवाई करते हुए मुस्लिम पक्ष की दलील को खारिज किया और हाई कोर्ट के निर्णय का समर्थन किया।
सुप्रीम कोर्ट ने स्पष्ट किया कि हिंदू पक्ष द्वारा मूल याचिका में संशोधन की अनुमति देना उचित था। हिंदू पक्ष ने इलाहाबाद हाई कोर्ट में दलील दी थी कि विवादित ढांचा भारतीय पुरातत्व सर्वेक्षण (एएसआई) के तहत संरक्षित स्मारक है और इस पर पूजा स्थल संरक्षण अधिनियम, 1991 लागू नहीं होता। अतः इसका उपयोग मस्जिद के रूप में नहीं किया जा सकता। इसी आधार पर हिंदू पक्ष ने एएसआई को मुकदमे में पक्षकार बनाने का अनुरोध किया था, जिसे हाई कोर्ट ने मार्च 2025 में स्वीकार कर लिया था।
मुस्लिम पक्ष की सुप्रीम कोर्ट में अपील
हाई कोर्ट के इस आदेश के खिलाफ मुस्लिम पक्ष ने सुप्रीम कोर्ट का रुख किया था। 4 अप्रैल को सुप्रीम कोर्ट ने इस अपील पर हिंदू पक्ष को नोटिस जारी किया था। आज सुनवाई के दौरान शीर्ष अदालत ने टिप्पणी की, “यह दलील बिल्कुल गलत है। हाई कोर्ट को मुकदमे में संशोधन की अनुमति देनी चाहिए थी।“
सुप्रीम कोर्ट ने मुस्लिम पक्ष को अपना लिखित जवाब दाखिल करने के लिए समय प्रदान किया और मामले की सुनवाई स्थगित कर दी।
विवाद का मूल आधार
हिंदू पक्ष का तर्क है कि 1920 में जारी एक अधिसूचना के तहत विवादित स्थल को संरक्षित स्मारक घोषित किया गया था, जो प्राचीन स्मारक संरक्षण अधिनियम की धारा 3 के तहत जारी की गई थी। इस आधार पर, पूजा स्थल अधिनियम-1991, जो धार्मिक स्थलों की स्वतंत्रता पूर्व स्थिति को संरक्षित करने का उद्देश्य रखता है, इस विवादित स्थल पर लागू नहीं होता।
वहीं मुस्लिम पक्ष का कहना था कि हिंदू पक्ष द्वारा किया गया संशोधन पूजा स्थल अधिनियम के तहत उनके बचाव को कमजोर करने का प्रयास है।
आगे की कार्रवाई
अब सुप्रीम कोर्ट में मुस्लिम पक्ष द्वारा दाखिल लिखित बयान के बाद इस मामले में आगे की सुनवाई होगी।
