नाबालिग से बलात्कार के दोषी को दोहरी उम्रकैद, पीड़िता को मुआवजे का आदेश

केरल के पेनावु फास्ट ट्रैक कोर्ट ने एक नाबालिग बच्ची से बलात्कार के मामले में ऐतिहासिक और सख्त फैसला सुनाते हुए आरोपी को दोहरी उम्रकैद की सजा सुनाई है। कोर्ट ने यह भी आदेश दिया कि दोषी को मृत्यु तक जेल में ही रखा जाए, साथ ही जिला विधिक सेवा प्राधिकरण को पीड़िता को पर्याप्त मुआवजा देने का निर्देश दिया गया है।
घटना का विवरण
विशेष लोक अभियोजक (एसपीपी) शिजो मोन जोसेफ ने बताया कि न्यायाधीश लाइजुमोल शेरिफ ने आरोपी एंटनी को IPC और POCSO एक्ट के तहत दोषी ठहराया। घटना 4 अगस्त 2021 को हुई जब आरोपी ने पीड़िता को उसके घर के पास एक चाय के बागान में खींचकर दुष्कर्म किया। विरोध करने पर आरोपी ने उसके चेहरे पर पत्थर से हमला कर गंभीर चोटें पहुंचाईं।
मुकदमे के दौरान अदालत ने 29 गवाहों और 35 दस्तावेजों की जांच की और पीड़िता का बयान संकेत भाषा के माध्यम से रिकॉर्ड किया गया।
पिछले मामलों से तुलना
इसी वर्ष जनवरी में तिरुवनंतपुरम की एक फास्ट ट्रैक कोर्ट ने ट्यूशन टीचर मनोज को नाबालिग लड़की से बलात्कार के मामले में 111 साल की सजा सुनाई थी। उसे 1.05 लाख रुपये जुर्माना भी देना पड़ा था। आरोपी की पत्नी ने उसके अपराध का पता चलने पर आत्महत्या कर ली थी। यह घटना 2 जुलाई 2019 की थी।
न्यायपालिका का सख्त रुख
इन मामलों से स्पष्ट है कि भारतीय न्याय व्यवस्था अब बच्चों के खिलाफ यौन अपराधों पर बेहद सख्त रुख अपना रही है और ऐसे अपराधियों के लिए दया का कोई स्थान नहीं है।
