वक्फ संशोधन विधेयक 2025 पर उठे संवैधानिक सवाल, बरेली मरकज़ में क़ाज़ी-ए-हिंदुस्तान की अध्यक्षता में हुई ऐतिहासिक बैठक
बरेली। भारत में सूफ़ी परंपरा का प्रमुख केंद्र बरेली मरकज़ एक बार फिर मुस्लिम समाज के संवैधानिक अधिकारों की रक्षा को लेकर एक ऐतिहासिक बैठक का गवाह बना। बीती रात क़ाज़ी-ए-हिंदुस्तान मुफ्ती मुहम्मद असजद रज़ा ख़ां कादरी की सदारत में वक्फ संपत्तियों की सुरक्षा और प्रबंधन के विषय पर एक अहम बैठक आयोजित की गई, जिसमें देशभर के उलेमा, वरिष्ठ अधिवक्ता, सामाजिक प्रतिनिधि और कोर कमेटी के पदाधिकारी शामिल हुए।
बैठक का मुख्य विषय हाल ही में संसद में पारित वक्फ (संशोधन) विधेयक 2025 रहा, जिसे लेकर मुस्लिम समाज में गहरी चिंता और असंतोष व्याप्त है।
क़ाज़ी-ए-हिंदुस्तान का स्पष्ट संदेश: संविधान के खिलाफ कोई क़ानून मान्य नहीं
बैठक को संबोधित करते हुए क़ाज़ी-ए-हिंदुस्तान मुफ्ती असजद रज़ा खां ने कहा:
“हमारे बुजुर्गों ने जो जायदादें अल्लाह की राह में वक्फ की थीं, वे हमारी धार्मिक और सामाजिक धरोहर हैं। संविधान हमें इन्हें बचाने और सही उद्देश्य के लिए उपयोग करने का अधिकार देता है। जो क़ानून शरीअत या संविधान के खिलाफ हो, वह स्वीकार्य नहीं हो सकता।”
उन्होंने विधेयक को एक सोची-समझी साजिश करार दिया और कहा कि यह संविधान की आत्मा के साथ खिलवाड़ है।
संवैधानिक और कानूनी बिंदुओं पर गंभीर आपत्ति
- अनुच्छेद 25 और 26 का उल्लंघन: धार्मिक स्वतंत्रता और संस्थागत स्वायत्तता का हनन।
- अनुच्छेद 246(3) का अतिक्रमण: राज्य अधिकार क्षेत्र में केंद्र का हस्तक्षेप।
- अनुच्छेद 14 का उल्लंघन: मुस्लिम वक्फ संपत्तियों को समान सुरक्षा नहीं।
- साम्प्रदायिक वर्गीकरण: अगाखानी और बोहरा वक्फ जैसी उपवर्गीय पहचान से सामाजिक विभाजन की आशंका।
- न्यायिक प्रक्रिया को दरकिनार: वक्फ विवादों का निपटारा प्रशासनिक अधिकारियों को देना न्याय सिद्धांतों के विरुद्ध।
मुंबई के एंटीलिया वक्फ विवाद का उल्लेख
बैठक में मुंबई स्थित एंटीलिया संपत्ति का उदाहरण देते हुए यह सवाल उठाया गया कि क्या सरकार ऐसे विवादित मामलों पर नियंत्रण पाने के लिए यह विधेयक लाई है?
सलमान मिया: “वक्फ संपत्तियाँ हमारी धार्मिक-सांस्कृतिक पहचान का प्रतीक हैं”
जमाअत रज़ा-ए-मुस्तफा के राष्ट्रीय उपाध्यक्ष सलमान हसन खान (सलमान मिया) ने कहा:
“हम भारत के जिम्मेदार नागरिक हैं और भारतीय संविधान हमें हमारे धार्मिक संस्थानों की रक्षा के लिए आवाज़ उठाने का अधिकार देता है। वक्फ संपत्तियाँ हमारी संस्कृति, इतिहास और धार्मिक पहचान का प्रतीक हैं। इन पर हमला असल में हमारी अस्मिता पर हमला है।”
उन्होंने अनुच्छेद 14 (समानता का अधिकार) और अनुच्छेद 21 (सम्मानजनक जीवन) का हवाला देते हुए विधेयक की निंदा की।
राष्ट्रव्यापी अभियान और कानूनी रणनीति
बैठक में लिए गए महत्वपूर्ण निर्णय:
- देशव्यापी जागरूकता अभियान चलाया जाएगा।
- सुप्रीम कोर्ट में कानूनी याचिका की तैयारी की जाएगी।
- प्रमुख उलेमा किराम की अगली राष्ट्रीय बैठक जल्द बुलाई जाएगी।
