High Court takes cognizance of the dilapidated roads of Jalna, notice issued to Municipal Corporation and Government
जालना की सड़कों की दुर्दशा पर हाईकोर्ट की सख्ती
जालना की खराब सड़कों, खुले मैनहोल और प्रशासन की लापरवाही पर बॉम्बे हाईकोर्ट की औरंगाबाद खंडपीठ ने जालना नगर निगम, महाराष्ट्र सरकार और जिला प्रशासन को नोटिस जारी किया है। यह मामला एक जनहित याचिका (PIL) के तहत अदालत के संज्ञान में आया, जिसे सामाजिक कार्यकर्ता और अधिवक्ता महेश धन्नावत ने दायर किया था। यह याचिका अधिवक्ता रूपेश जायसवाल के माध्यम से दायर की गई थी. याचिका में नगर निगम की उदासीनता और खराब सड़क व्यवस्था को गंभीर मुद्दा बताया गया है।
याचिका में उठाए गए अहम मुद्दे
1. सड़कें खस्ताहाल, लोगों की जान जोखिम में
याचिकाकर्ता महेश धन्नावत ने अदालत को बताया कि जालना की सड़कों पर गड्ढों और खुले मैनहोल की वजह से आम नागरिकों, विशेषकर स्कूली बच्चों, को भारी परेशानियों का सामना करना पड़ रहा है। उन्होंने अदालत से मांग की कि सड़क निर्माण और मरम्मत कार्यों में टिकाऊ और उच्च गुणवत्ता वाली सामग्री का उपयोग किया जाए, जिससे सड़कों की हालत लंबे समय तक बेहतर बनी रहे।
2. खोदी गई सड़कों की दुर्दशा
याचिका में इस बात का भी जिक्र किया गया कि जालना शहर की कई सड़कों को जल पाइपलाइन, सीवेज पाइप और केबल वायर बिछाने के लिए खोदा गया था। लेकिन काम पूरा होने के बाद इन सड़कों की मरम्मत नहीं की गई, जिससे नागरिकों को भारी दिक्कतों का सामना करना पड़ रहा है। इस लापरवाही के कारण सड़कों पर कई जगह जानलेवा गड्ढे बन गए हैं, जिससे दुर्घटनाओं का खतरा बढ़ गया है।
3. अतिक्रमण और ट्रैफिक जाम की गंभीर समस्या
याचिका में यह भी बताया गया कि शहर की कई सड़कों पर अवैध अतिक्रमण बढ़ते जा रहे हैं, जिससे वाहन चालकों को ट्रैफिक जाम जैसी समस्याओं से जूझना पड़ रहा है। खासतौर पर स्कूल जाने वाले मार्गों पर यह समस्या गंभीर होती जा रही है, जिससे स्कूली बच्चों की सुरक्षा को लेकर चिंताएं बढ़ गई हैं।
4. मौलिक अधिकारों का हनन
याचिकाकर्ता ने अदालत के समक्ष तर्क दिया कि नगर निगम की लापरवाही से नागरिकों का अनुच्छेद 21 (जीवन के अधिकार) का उल्लंघन हो रहा है। उन्होंने दावा किया कि नगर निगम के अधिकारियों को इस संबंध में कई बार शिकायत दी गई, लेकिन कोई ठोस कार्रवाई नहीं हुई। इस वजह से उन्हें न्यायिक हस्तक्षेप की मांग करनी पड़ी।
हाईकोर्ट ने मांगा जवाब, अगली सुनवाई 19 मार्च को
अब बॉम्बे हाईकोर्ट की औरंगाबाद खंडपीठ ने नगर निगम, महाराष्ट्र सरकार और जिला प्रशासन से जवाब तलब किया है। न्यायमूर्ति मंगेश पाटिल और प्रफुल्ल खुबलकर की खंडपीठ ने इस मुद्दे को गंभीर मानते हुए अगली सुनवाई 19 मार्च को निर्धारित की है।
अब देखना होगा कि जालना नगर निगम और प्रशासन इन गंभीर नागरिक समस्याओं को लेकर क्या स्पष्टीकरण देते हैं और अदालत इस पर क्या रुख अपनाती है।
