नई दिल्ली: हाल ही में पारित वक्फ संशोधन विधेयक अब कानून बन चुका है, जिसे राष्ट्रपति द्रौपदी मुर्मू ने भी अपनी मंजूरी दे दी है। केंद्र सरकार इसे बड़ी वैधानिक सफलता मान रही है। लेकिन इस कानून को लेकर अब देश की सर्वोच्च अदालत में चुनौती दी गई है, जिससे राजनीतिक गलियारों में हलचल तेज हो गई है।
क्या सुप्रीम कोर्ट संसद द्वारा पास किए कानून को रद्द कर सकता है?
इस सवाल का जवाब है – हां, यदि वह कानून संविधान के मूल ढांचे का उल्लंघन करता हो। भारतीय संविधान के तहत, सुप्रीम कोर्ट के पास किसी भी कानून की वैधता की समीक्षा करने का अधिकार है। यदि कोई कानून मौलिक अधिकारों को प्रभावित करता है या धर्मनिरपेक्षता, स्वतंत्रता, समानता जैसे मूल तत्वों के विरुद्ध है, तो कोर्ट उसे असंवैधानिक घोषित कर सकता है।
विपक्ष की याचिका का कानूनी आधार क्या है?
विपक्षी दलों जैसे कांग्रेस, आम आदमी पार्टी और AIMIM ने सुप्रीम कोर्ट में अनुच्छेद 32 के अंतर्गत याचिका दायर की है। अनुच्छेद 32 नागरिकों को उनके मौलिक अधिकारों के उल्लंघन की स्थिति में सीधे सुप्रीम कोर्ट जाने की अनुमति देता है। विपक्ष का दावा है कि वक्फ कानून मुस्लिम समुदाय की धार्मिक स्वतंत्रता और सांस्कृतिक अधिकारों पर हमला करता है।
वक्फ कानून पर आपत्तियाँ क्या हैं?
- धार्मिक स्वतंत्रता पर असर: वक्फ बोर्ड में गैर-मुस्लिम सदस्यों की नियुक्ति से मुस्लिम समुदाय की धार्मिक स्वायत्तता प्रभावित होगी।
- ‘बाय यूजर क्लॉज’ का हटाया जाना: इससे बिना दस्तावेज वाली वक्फ संपत्तियाँ अवैध घोषित हो सकती हैं, जिससे समुदाय की जमीनों पर अधिकार समाप्त हो सकता है।
- अल्पसंख्यक अधिकारों का उल्लंघन: विपक्ष का आरोप है कि यह कानून अल्पसंख्यकों की संस्थाओं को नियंत्रित करने का प्रयास है।

भारत में सुप्रीम कोर्ट कई बार संसद द्वारा पारित कानूनों की समीक्षा कर चुका है। उदाहरण स्वरूप:
- CAA-NRC को लेकर सुप्रीम कोर्ट में कई याचिकाएँ दाखिल हुईं।
- अनुच्छेद 370 को हटाने के फैसले को भी चुनौती दी गई थी।
- तीन तलाक कानून पर भी संवैधानिक बहस हुई थी।
निष्कर्ष: यदि सुप्रीम कोर्ट यह पाता है कि वक्फ कानून संविधान के मूल सिद्धांतों का उल्लंघन करता है, तो वह इसे रद्द भी कर सकता है। यह मोदी सरकार के लिए कानूनी और राजनीतिक रूप से एक बड़ा झटका साबित हो सकता है।
