सुप्रीम कोर्ट की फटकार: सतपीर दरगाह विध्वंस पर लगाई रोक, हाई कोर्ट की कार्यप्रणाली पर उठाए सवाल

सतपीर दरगाह विध्वंस मामले में सुप्रीम कोर्ट ने बड़ी टिप्पणी करते हुए कहा कि धार्मिक स्थलों की संरचना से संबंधित किसी भी विध्वंस की आशंका अत्यंत गंभीर और संवेदनशील मुद्दा है। जस्टिस पीएस नरसिम्हा और जस्टिस जॉयमाला बागची की पीठ ने इस मामले की सुनवाई के दौरान बॉम्बे हाई कोर्ट की प्रक्रिया पर भी सवाल खड़े किए और नगर निगम की कार्रवाई पर रोक लगा दी।
क्या है मामला?
सतपीर दरगाह नासिक के काठे गली इलाके में स्थित है और यह लंबे समय से विवादों का केंद्र रही है। 1 अप्रैल 2025 को नासिक नगर निगम ने दरगाह को “अनधिकृत” बताते हुए विध्वंस नोटिस जारी किया था। इसके विरुद्ध 8 अप्रैल को दरगाह ट्रस्ट ने बॉम्बे हाई कोर्ट में याचिका दाखिल की, लेकिन बार-बार प्रयासों के बावजूद मामले को सूचीबद्ध नहीं किया गया। मजबूरी में याचिकाकर्ताओं ने सुप्रीम कोर्ट का रुख किया।
सुप्रीम कोर्ट की नाराजगी
सुप्रीम कोर्ट ने याचिका सूचीबद्ध न किए जाने पर नाराजगी जताते हुए कहा,
“हमें नहीं पता कि 9 अप्रैल से अब तक क्या हुआ। वकील का कहना है कि वे हर दिन प्रयास कर रहे थे।”
कोर्ट ने इसे असामान्य स्थिति मानते हुए विध्वंस पर “अस्थायी रोक” लगाई और हाई कोर्ट के रजिस्ट्रार जनरल को मामले की सूचीबद्धता पर रिपोर्ट सौंपने का निर्देश दिया। अगली सुनवाई 21 अप्रैल को तय की गई है।
विध्वंस के दौरान हिंसा और तनाव
हाई कोर्ट के आदेश का हवाला देते हुए नासिक नगर निगम ने बुधवार सुबह दरगाह का विध्वंस कर दिया, जिससे इलाके में भारी तनाव फैल गया। काठे गली क्षेत्र में पथराव और झड़पें हुईं, जिसमें 21 पुलिसकर्मी घायल हुए और 3 वाहन क्षतिग्रस्त हो गए।
पुलिस कमिश्नर संदीप कर्णिक ने बताया कि दरगाह ट्रस्ट मंगलवार रात से ही विध्वंस प्रक्रिया में सहयोग कर रहा था, लेकिन अचानक उस्मानिया चौक पर भीड़ ने पथराव शुरू कर दिया। पुलिस को हालात काबू में लाने के लिए लाठीचार्ज और आंसू गैस का सहारा लेना पड़ा। 15 लोगों को हिरासत में लिया गया है।
पुराना विवाद और स्थानीय राजनीति
फरवरी 2025 में नगर निगम ने दरगाह क्षेत्र की अनधिकृत संरचनाओं के खिलाफ अभियान चलाया था, लेकिन मुख्य दरगाह को नहीं छुआ गया था। इस पर स्थानीय हिंदू संगठनों और भाजपा विधायक देवयानी फरांदे ने आपत्ति जताते हुए कहा था कि दरगाह पूरी तरह अनधिकृत है और इसे हटाना जरूरी है।
सुप्रीम कोर्ट का सख्त संदेश
कोर्ट ने साफ किया कि धार्मिक ढांचों से जुड़े मामलों में न्यायिक देरी से अपूरणीय क्षति हो सकती है। इसलिए ऐसे मामलों में “तत्काल सुनवाई आवश्यक” है। हाई कोर्ट के रजिस्ट्रार जनरल को निर्देश दिया गया है कि वे सूचीबद्धता में हुई देरी का स्पष्टीकरण दें।
