The US Government Accountability Office has concluded that the Trump administration cannot continue withholding more than $800 million in approved federal spending beyond the fiscal year deadline.
AP reported that the money is tied to 11 appropriations accounts. The GAO said federal law requires funds proposed for rescission to remain available unless Congress completes the required process.
Congressional spending authority at issue
The dispute centers on the constitutional and statutory roles of Congress and the executive branch in federal spending. The GAO said withholding appropriated funds beyond their expiration date would undermine Congress’s power of the purse.
The issue could influence future disputes over presidential authority to delay or cancel spending approved by Congress.
