A dispute between two women over a rescued street dog reached the Calcutta High Court, which has now quashed the criminal proceedings after finding that the animal was healthy and receiving proper care. In an order dated October 9, 2026, Justice Chaitali Chatterjee Das also permitted the complainant to visit the dog once a month, subject to the current custodian’s prior consent and safeguards for the animal’s welfare.

According to a report published by Law Trend on October 15, the petitioner said she rescued the then six-to-seven-month-old puppy in November 2024, arranged medical treatment and intended to adopt it without any payment. The complainant maintained that she had rescued the puppy first and alleged that the petitioner took it without permission or completing adoption formalities. The petitioner sought to quash the resulting criminal case in 2025.

The court considered a police report following an arranged visit, veterinary records and a recent photograph. The dog, now about two years old, was reported to be in good health. Finding no reason to continue the proceedings, the court quashed the case while recognising both women’s concern for the animal.

Advocate Mahesh Dhannawat of Jalna commented: “Animal welfare must remain the first priority. Compassionate rescuers should not be pushed into prolonged criminal disputes when the animal is safe and properly cared for. Clear adoption records and respectful cooperation can prevent such conflicts.” His remarks are a general perspective on responsible animal care, not part of the court’s judgment.

The ruling highlights the value of animal welfare, cooperation and evidence-based resolution of disputes. The monthly visit is conditional; it is not an unrestricted custody or access right.
