CHICAGO, Oct. 7, 2026: Marimar Martinez, a US citizen who was shot five times by a federal immigration agent during a Chicago enforcement operation last year, has sued the federal government, alleging that the official account of the shooting was false.
Lawsuit challenges government’s account
Martinez says a Customs and Border Protection agent fired into her vehicle from behind. The incident became a prominent flashpoint in the debate over federal immigration enforcement tactics in Chicago and the level of force used during large-scale operations.
Earlier criminal charges connected with the confrontation were dismissed with prejudice, meaning those charges cannot be refiled. A federal judge also previously allowed body-camera footage and other evidence connected with the case to be released publicly.
Case adds to scrutiny of immigration enforcement
The civil lawsuit comes amid continuing national debate over immigration raids, federal law-enforcement accountability and the government’s description of use-of-force incidents. The allegations in the lawsuit remain claims to be tested through the legal process.
Martinez has publicly argued that what happened to her should concern Americans beyond the immigration debate. The government will have an opportunity to respond to the claims in court.
