The Cornell Chi Phi controversy now involves two separate legal tracks: a civil lawsuit filed by a former student and a criminal investigation reopened by the Tompkins County District Attorney.
A civil lawsuit seeks remedies such as monetary damages and addresses claims under civil law. The plaintiff must establish the required elements under the applicable civil standard.
A criminal prosecution is brought by the government. Prosecutors must establish criminal liability under the applicable criminal standard. In this case, the district attorney has said the evidence will be presented to a grand jury, which may determine whether an indictment should be issued.
The civil complaint alleges that seven former fraternity members sexually assaulted the plaintiff. The defendants have disputed those claims. The district attorney has separately said the plaintiff’s original 2024 statement differed from the later lawsuit, while her attorney disputes that description.
Cornell’s internal disciplinary proceedings are another separate process governed by university policies.
