Supreme Court Opens New Term With Big Oil Climate Case That Could Reshape Local Lawsuits

Washington: The US Supreme Court begins its new term with a closely watched dispute involving ExxonMobil and Suncor Energy and a climate lawsuit brought by Boulder, Colorado, and local governments.

The companies argue that federal law prevents the local governments from using state law to pursue claims seeking damages over climate-related harms. The Colorado plaintiffs argue their claims concern alleged deceptive conduct and local damages.

Why the case matters nationally

Nearly 60 state and local governments have brought similar cases against fossil-fuel companies, according to Reuters. The court’s eventual decision could therefore influence litigation far beyond Colorado.

The Supreme Court’s consideration of the legal questions does not establish that either side’s claims are correct. The case will turn on questions of federal and state authority and the legal theories underlying the lawsuits.
