New Delhi: The CCPA action against Amazon, Flipkart and JioMart has brought attention to the regulatory framework governing the online sale of agricultural chemicals in India.
Role of the Insecticides Act
During the proceedings, the Department of Agriculture and Farmers Welfare informed the CCPA that the import, manufacture, sale, transport, distribution and use of insecticides and pesticides are regulated under the Insecticides Act, 1968 and related rules.
The department’s submission became part of the regulator’s examination of a product marketed as Cyclosinone Herbicide, which it said was not included in the relevant Schedule.
Online marketplace obligations
The CCPA also examined the responsibilities of e-commerce platforms. The regulator rejected the argument that third-party seller arrangements alone could remove the platforms’ statutory responsibilities.
This case therefore sits at the intersection of agricultural regulation, consumer protection and e-commerce compliance.
