ITHACA, New York, October 2, 2026: New York Gov. Kathy Hochul has appointed Attorney General Letitia James as a special prosecutor to oversee an investigation into allegations of a 2024 sexual assault at a Cornell University fraternity house. The decision follows renewed attention to the case and criticism of the earlier handling of the investigation.

Associated Press reported that the local district attorney had initially closed the criminal investigation without charges in 2024 and later reopened it after new attention surrounding a civil lawsuit. Hochul said she had lost confidence in the local prosecutor’s ability to handle the matter and ordered the special-prosecutor arrangement. citeturn0news4

What triggered the renewed investigation

The allegations became the subject of renewed public attention after the woman who says she was assaulted filed a civil lawsuit. The lawsuit contains allegations that remain disputed and have not been established as criminal findings. The special prosecutor will review the available evidence and determine how the criminal investigation should proceed.

Why a special prosecutor was appointed

A special prosecutor can provide an investigation separate from the local prosecutor’s office. In this case, the governor said the appointment was intended to address concerns about public confidence in the earlier handling of the allegations. The appointment does not itself establish that any individual committed a crime.

Role of the New York attorney general

The attorney general’s office will oversee the investigation under the authority granted by the governor’s executive order. Investigators can review police records, witness statements, digital evidence, prior investigative decisions and other material that may be legally obtained.

Cornell’s response

Cornell University has announced an independent review of its own actions in connection with the allegations and has suspended the fraternity involved. The university’s institutional review is separate from the criminal investigation conducted by the special prosecutor.

Why campus sexual-assault cases can be complex

Sexual-assault investigations can involve delayed reporting, conflicting accounts, digital communications, witness availability and questions about consent. Investigators must evaluate evidence rather than simply relying on public discussion. Criminal prosecutors must also determine whether available evidence satisfies the legal standard for charges.

Civil and criminal cases are different

A civil lawsuit and a criminal prosecution have different purposes and standards. A civil case can seek damages or other remedies, while a criminal prosecution can result in penalties if guilt is established. Allegations made in a civil complaint are not automatically proof of criminal conduct.

Importance of preserving evidence

Modern investigations may involve text messages, social-media posts, photographs, access records and other digital information. Investigators must determine whether such evidence is authentic, relevant and legally admissible. The existence of a message or recording does not automatically establish the context in which it was created.

Protecting the alleged victim

Sexual-assault cases require careful handling of personal information. News organizations should avoid unnecessary details that could identify or further harm an alleged victim. Public reporting should focus on verified procedural developments and clearly attribute allegations to the appropriate legal documents or officials.

Due process for people accused

People accused of crimes are entitled to due process and are presumed innocent unless convicted. A renewed investigation does not mean charges will necessarily follow. Prosecutors must independently assess the evidence before deciding whether criminal charges are justified.

What happens next

The special prosecutor will review the case and may interview witnesses, examine evidence and consult investigators. Further decisions could include additional investigation, criminal charges, or closure if the evidence does not support prosecution.

Source note: Allegations described in civil filings remain allegations unless established through evidence and legal proceedings. This report does not make an independent finding about the underlying accusations.
